Privacy and Processing of Personal Data
Please read our Terms of Privacy and Handling of Personal Data before you send us YOUR personal data.
1. Our Commitment
At ESSS, we value the freedom, privacy and unfettered development of people’s personalities. Therefore, we understand that the proper processing of personal data is fundamental. This is our commitment to YOU. Thus, in a simple, objective and transparent way, we want to bring you information about how we handle personal data. Our Personal Data Processing Policy applies to all companies of the ESSS Group, unless otherwise clearly stated.
For ESSS:
1.1 Personal data
Is any information that identifies or may identify YOU (native – the term “native” means “natural person”). For instance: your name, social security number, address, telephone number, e-mail, etc.
1.2 Processing of data
Means any operation performed with personal data, such as collection, production, receipt, classification, use, access, reproduction, transmission, distribution, processing, filing, storage, deletion, evaluation or control of the information, modification, communication, transfer, dissemination or extraction.
2. Do we process personal data?
Yes, we process visitors and users of our digital platforms personal data and also that of our prospects, customers, suppliers, partners and employees. Data processing may be carried out directly by us or by third parties.
Below are examples of personal data we may process:
- CONTACT AND REGISTRATION DATA: full name, e-mail, position, national registration number, telephone, address, and personal department data.
- DIGITAL IDENTIFICATION DATA: login information, IP address, operating system version, geolocation, browser type and version, pages accessed, date and time of visit, time spent on pages, unique device identifiers, and public social media data.
- OTHER DATA: answers to optional questionnaires and surveys, financial and payment information.
Important: As a general rule ESSS does not require sensitive personal data: racial or ethnic origin, religious belief, political opinion, membership of a trade union or religious, philosophical or political organization, data concerning health or sex life, genetic or biometric data when linked to a natural person. However, when necessary, it does process sensitive personal data of its employees.
Important: Our digital platforms may contain links to other platforms that are beyond our control and are not covered by these Privacy and Processing of Personal Data terms. By accessing these links, the operators of these platforms may collect YOUR personal data which will be treated in accordance with their policies.
3. Why do we process your personal data?
We process personal data for the following purposes:
3.1 Interaction
To interact with our potential clients, customers, suppliers and partners, provide our services, technical support, fulfill requests, send information, news, announcements, invitations, advertising, and others.
3.2 Improvement
To enhance and develop our services and improve our digital platforms (browsing experiences, usability of tools, customization of ads and other content based on preferences, as well as creating and maintaining secure and trusted environments).
3.3 Marketing
To send you our marketing messages, advertising, promotions, offers and other information. You may opt-out of receiving information about our products and services by selecting the unsubscribe link found at the bottom of our e-mail communications or by sending an e-mail to privacy@esss.co.
3.4 Contractual relationships
For the execution of our contracts (including pre-contractual and post-contractual phases) with customers, suppliers, business partners, and employees.
3.5 Legal obligations
To comply with all of our legal obligations.
3.6 Legitimate interests
To serve our legitimate interests (supporting and promoting our activities and facilitating the regular exercise of our rights, including legal, administrative or arbitration proceedings) or those of third parties.
4. How do we protect your personal data?
Taking care of YOUR personal data is essential to us. Therefore, we employ measures and use technologies to help protect and safeguard the security, integrity and confidentiality of YOUR personal data, seeking to prevent unauthorized access and accidental or unlawful destruction, loss, alteration, communication or disclosure.
But remember: even with all our efforts and concerns, no measure and no technology is 100% safe.
5. How long do we keep your personal data?
We keep YOUR personal data stored for as long as necessary to:
- Comply with our legal obligations;
- Fulfill our contractual relationships; and,
- Fulfill our legitimate interests (Interaction, improvement, marketing, etc).
Thus, the termination of the processing of YOUR personal data will take place when:
- Our legal obligations are properly fulfilled;
- The corresponding goals have been achieved;
- They are no longer necessary or pertinent to the achievement of the corresponding goals.
We may also terminate the processing of YOUR personal data:
- When YOU request it, provided that there is no other legal basis justifying continued treatment; or
- By determination of Authorities responsible for the protection of personal data.
6. Do we share your personal data?
6.1 Third Party Services
We use the services of third parties, therefore YOUR personal data may be shared as necessary for the provision of the services by the third parties and as necessary to fulfill the purposes described herein.
6.2 Business Partners and Related Companies
We share YOUR personal data with ‘Business Partners’ (companies that are not part of the ESSS Group but that do business with the ESSS Group) and ‘Related Companies’ (all companies that are or may be controlled by, controlling, affiliated with or under common control with the ESSS Group).
6.3 Marketing Partners
We may share YOUR personal data with sponsors of events, webinars or sweepstakes for which you register or other parties with whom we may engage in joint marketing activities.
Important: We do NOT share YOUR personal data to gain economic advantage by sharing it.
6.4 International Data Transfer
In the scheme of processing YOUR personal data we use tools located in several countries. Therefore, YOUR personal data may be transferred to and maintained on computers located outside your country (or other jurisdiction) where data protection laws may be different. We strive to ensure that YOUR data is treated securely and according to the provisions herein and is not transferred to a country or organization that does not have an adequate level of protection for personal data.
7. Your rights
We respect YOUR rights. Therefore, we consider it necessary to inform them in a clear and ostentatious way. YOU, the holder of personal data processed by us, have the following rights:
Obtain from the Controller, according to the legal deadlines, upon YOUR request:
- confirmation of the existence of processing of YOUR personal data;
- access to YOUR personal data;
- correction of YOUR incomplete, inaccurate or outdated personal data;
- anonymization, blocking or deletion of YOUR personal data that is unnecessary, excessive or treated in violation of the law;
- portability of YOUR personal data to another service or product provider upon YOUR request and subject to commercial and industrial confidentiality (does not include data that has already been anonymized);
- deletion of YOUR personal data processed with consent;
- information from the public and private entities with which we share YOUR personal data;
- information about the possibility of not providing YOUR consent and what the consequences of not providing YOUR consent are;
- revocation of YOUR consent, upon YOUR specific request.
To petition the Authorities responsible for the protection of personal data concerning your data;
To oppose processing carried out based on one of the hypotheses for waiving consent, in case of non-compliance with the provisions of the Law;
The rights provided here must be exercised upon YOUR request or that of YOUR legal representative, addressed to our Officer (details below). In YOUR request, we advise you to inform us, at least: i) YOUR identification (WHO ARE YOU); ii) description of YOUR request (WHAT DO YOU WANT); and, iii) documents (DOCUMENTS YOU THINK ARE NEEDED OR RELEVANT TO YOUR REQUEST).
8. Controller and Data Protection Officer
The ‘Controller’ is the person responsible for decisions concerning the processing of personal data. In the ESSS Group the Controller is ENGINEERING SIMULATION AND SCIENTIFIC SOFTWARE LTDA. – CNPJ 00.796.437/0001-83 (www.esss.co). The person who carries out the processing of personal data on behalf of the Controller is called the ‘Data Protection Officer’.
The ‘Data Protection Officer’ is the person appointed by the Controller to act as a communication channel between the Controller, the data subjects (YOU) and the National Data Protection Authority and other Authorities responsible for the protection of personal data. The ‘Data Protection Officer’ is responsible for:
- Accept YOUR complaints and comments, provide clarifications, and take action;
- Receive communications from the National Data Protection Authority and other Authorities responsible for the protection of personal data and adopt measures;
- Guide employees and those hired on the practices to be taken regarding the protection of personal data; and
- Perform the other attributions determined by the Controller or established in applicable norms.

9. Cookies
9.1 What are cookies?
Cookies are files sent to your computer or mobile device by the browser or application you use. When you re-enter the site, the cookie allows the site to identify information such as your browser, user preferences, email address, search preferences, the city from which you are connecting, and more. There is no limit to what information cookies can store.

9.2 What are cookies for?

9.4 What categories of cookies do we use?
9.4.1 Required
They help make our digital platforms usable and more secure. They enable the use of functions, services and features, such as page navigation and access to restricted areas of the platforms (security to authenticate users, prevent fraudulent use of login credentials, etc.). The platforms may not function properly without these cookies.
9.4.2 Statistical
They help understand how visitors interact with our digital platforms by collecting and reporting information anonymously (number of visitors, how visitors arrived at the platforms, which pages were accessed, etc.).

Third party cookies are owned and managed by other companies, such as business partners or service providers. These cookies, with our permission, may be necessary to produce certain forms, such as a job application, or to enable some advertising outside our digital platforms, for the purposes set out in this policy.

From time to time, we may change these Data Privacy Terms. When we do, we will post the changes on our digital platforms.
